Subscriptions Terms & Conditions
Referred to as the “Site”, owned and operated by Guitar Excellence CC and GE Online PTY (Ltd). (“Guitar Excellence” & “GE Online”). Subject to the following Terms and Conditions (T&Cs), Guitar Excellence provides users of the Site with access to a collection of guitar lessons, guitar courses, guitar-playing resources, and forums of users and subscribers (the “Services”). Guitar Excellence & GE Online reserves the right to amend these from time to time and at any time. The most current version of the T&C is posted at Guitar Excellence’s website domains, and subscribers are responsible for reviewing the T&C to ensure knowledge of such modifications. Use of the Services by a user shall constitute that subscribers acceptance of these Terms and Conditions
Guitar Excellence & GE Online Services
Video Lesson Subscription
Guitar Excellence & GE Online provides access to the Site and its Services. Any visitor to the Site will be able to access only basic information about the Site and the Services of Guitar Excellence & GE Online. Site visitors may register and subscribe to use the Site by providing basic information to Guitar Excellence & GE Online to receive access to Site Services. Subscription requires periodic payments to take and remain in effect. Subscribers agree to pay for the subscription period selected at the time of purchase. Subscribers will receive a confirmation notice upon their original effective date. It is the subscriber’s responsibility to review the notice to ensure that it accurately reflects the requested subscription period. The subscriber may incur some additional fees from our payment gateway. This account must be created for users 13 and older. If someone under the age of 13 uses the account, a parent or guardian must be present at all times. Subscription renewal is automatic, and subscribers authorise automatic renewal of their subscriptions until canceled. Subscribers can cancel the automatic renewal of their subscription at any time via PayPal/PayFast or in their account. You can cancel your subscription at www.paypal.com or logging into their account. We hold a 7-day money back guarantee on this service provided the subscriber has logged into his account for a minimum of 60 minutes within 7 days.
Online Lesson Subscription
Guitar Excellence CC and GE Online PTY (Ltd) operate as a subscription service consisting of four (4) guitar lessons online per month. Some months may contain five (5) lessons in the month and/or less for public holidays. Guitar lessons are not provided on public holidays within South Africa. Every year in December there will be no lessons for a period of three (3) to four (4) weeks. These lessons are accounted for throughout the year with months that have five (5) lessons in them. Pupils that have commenced lessons for longer than three (3) months cannot use November as termination month within the fiscal year and will use December as your termination month.
Every effort will be made to make sure everything is in top running order to make sure your lessons will be smooth as possible and uninterrupted. In the event that the lesson is interrupted due to technical problems like weather, electricity interruptions, load-shedding, bad connections, or any other cause whatsoever, then the lesson will be rescheduled and/or reconnected at the teachers discretion. If lessons are interrupted due to any of the above causes outside of the teachers control, these lessons will be made up and no refunds or credits will be given. All online lesson subscriptions are non-refundable. Guitar Excellence and GE Online may from time to time at its discretion provide refunds in exceptional circumstances.
A working computer that has an online meeting platform like Zoom or Skype and a working webcam is also required for online lessons. The pupil accepts and agrees that the Internet connection used while having lessons is of acceptable speed and bandwidth. The minimum requirement for online lessons is a 10Mb Internet connection. Guitar Excellence and GE Online are not responsible for the success, motivation, commitment and progress of any pupil. Every effort will be made to ensure steady progress is made if the pupil practices according his or hers workload. We cannot guarantee results on Guitar Excellence and GE Online’s behalf. Your payment subscription for this service is valid for one month of 30 days. In the 30-day period you may receive four or five lessons. Public holidays are only accountable for South African holidays only at the moment and your instructor will inform you ahead of time when these are applicable.
Subscription renewal is automatic, and subscribers authorise automatic renewal of their subscriptions until canceled. Guitar Excellence and GE Online HQ is based in South Africa and work in the following Standard Time Zone of GMT/UTC + 02:00 hour with no daylight savings applicable. Guitar Excellence and GE Online is committed to meticulous screening of instructors to ensure that only top quality professional guitar instructors are chosen for its clients. However, Guitar Excellence and GE Online cannot be held responsible for the actions and conduct of its instructors. Each guitar instructor has contracted with Guitar Excellence and GE Online as an independent contractor, operating with the support and under the guidance and systems of Guitar Excellence and GE Online. Therefore, the customer hereby indemnifies and holds Guitar Excellence and GE Online harmless against any and all claims arising from any act or omission by the instructor whilst rendering instruction under the auspices of Guitar Excellence and GE Online.
If a contractor under Guitar Excellence CC and GE Online PTY (Ltd) is prevented from performing duties under your contract by vis major or casus fortuitus then Guitar Excellence CC, GE Online PTY (Ltd) and, our contractors are discharged from liability. This includes acts beyond our control in fulfilling our subscription obligations like government intervention and acts of God under Force Majeure. Should the client become aware of any concern relating to the quality, behavior or actions of an instructor, they hereby agree to contact Guitar Excellence and GE Online immediately.
Reservation of Rights
Guitar Excellence and GE Online reserve the right to terminate and/or cancel a pupil or subscribers’ subscriptions or access to the site at any time for any reason.
Username/Password Protection
Upon registering for video lessons, subscribers will choose a username and password that will permit them to access the appropriate level of services for the Site. Subscribers to the Site agree to take all reasonable steps to protect and ensure the accuracy of any login, password or payment information provided in connection with the Services. Subscribers agree to be the sole users of their username/password and the Services, and to promptly notify Guitar Excellence and GE Online if this is not the case. Guitar Excellence and GE Online may terminate access and deactivate or delete a user’s account without prior notice and without obligation. Guitar Excellence and GE Online reserve the right to restrict access to the Services to any user, and may at any time without notice immediately deny access by any person.
If your teacher needs to cancel a lesson and cannot make it up you will be credited via PayPal/PayFast. If a pupil needs to cancel their lesson the that lesson will be forfeited. Subscribers can cancel the automatic renewal of their subscription with one full calendars months notice of thirty (30) days time except November if you had lessons for longer than three (3) months in a fiscal year. In the event that you wish to cancel your subscription in November your termination month will be December. A full calendar month constitutes as the starting day of the first (1st) to the thirtieth (30th) day of the month. To do so, contact Guitar Excellence CC, GE Online PTY (Ltd) and authorise your cancellation of subscription. Your account will be canceled within two (2) business days of receipt upon your expired termination month. Guitar Excellence and GE Online will cancel any subscription on a pupil’s behalf via PayPal/PayFast. Your payment subscription for this service is valid for one month of 30 days. In the 30-day period you may receive four or five lessons. Public holidays are only accountable for South African holidays only at the moment and your instructor will inform you ahead of time when these are applicable.
Subscription renewal is automatic, and subscribers authorise automatic renewal of their subscriptions until canceled. A termination survey may be sent to the pupil to be filled out by the pupil in order to help us improve our services and products. Guitar Excellence and GE Online HQ is based in South Africa and work in the following Standard Time Zone of GMT/UTC + 02:00 hour with no daylight savings applicable.

Intellectual Property Notices
All notes, PDFs, tutorial videos and examination resources are the property of Guitar Excellence CC and GE Online PTY (Ltd), unless otherwise stated. The learner to whom they are given may only use them. The client and learner agree not to copy, photocopy, email, scan, distribute or make any form of replication of such resources, without the express permission of Guitar Excellence CC and GE Online PTY (Ltd). All songs, music notes and other notes that are given to pupils during lessons are for the sole purpose of learning and is an interpretation of the musical work and is under copyright to Guitar Excellence CC and GE Online PTY (Ltd). Use Restrictions

Print and Download Restrictions
The Site may at times contain proprietary and original material licensed from Third Parties. The terms under these licenses may prohibit the downloading and/or printing of such material by users. Guitar Excellence CC and GE Online PTY (Ltd) is obliged under such licenses to disable the user’s ability to download and/or print such content. You may purchase the material via our shop from authorised resellers and affiliates. Any attempt by users and subscribers to circumvent these restrictions is a violation of this T&C agreement and may result in termination of service and appropriate legal action. Videos that can be downloaded legally on our site will have a one (1) download per one (1) user limit for video downloads on our app per day.

The site www.guitarexcellence.co.za allows the user, to place electronic orders (“order”) for one or more products on offer as long as such products are available and not sold out to a current pupil of Guitar Excellence CC & GE Online (Pty) Ltd.
A purchasing contract (“sale”) between you and Guitar Excellence CC & GE Online (Pty) Ltd only comes into effect once you have fully completed and submitted the online order form for one or more products in your basket (“shopping cart”) AND your payment has been authorized by Guitar Excellence CC & GE Online (Pty) Ltd and cleared into our bank account. Products on Guitar Excellence CC & GE Online (Pty) Ltd cannot be reserved to be bought at a later stage, and placing an item in your basket without completing the order does not amount to a sale or an order. Cancelling and Ending Orders
Guitar Excellence CC & GE Online (Pty) Ltd reserves the right to refuse processing of payment for any order and/or to cancel any purchase, partially or completely, with notice given to you. Guitar Excellence CC & GE Online (Pty) Ltd will be liable for reimbursing you the rand value paid only if you have already paid for the cancelled order. You have the right to return item(s) purchased within a fourteen (14) day period from purchase date provided goods are unopened, un-used and return in original condition and packaging. This is only for physical goods and not services.
Fraud
Guitar Excellence CC & GE Online (Pty) Ltd reserves the right, in the interest of preventing fraud, to refuse the processing of payment for any order and/or to cancel any purchase, partially or completely. Guitar Excellence CC & GE Online (Pty) Ltd may request documentation to complete the necessary fraud checks and cancel any order where the necessary documentation is not provided in a timely manner.
In the event of a fraudulent purchase being placed on Guitar Excellence CC & GE Online (Pty) Ltd, cardholders will be advised to initiate a chargeback via their bank in order to be refunded. Guitar Excellence CC & GE Online (Pty) Ltd does not process refunds for orders suspected of fraud. The relevant banking or online payment gateway will initiate a resolution and further instructions. Product Pricing
The Regular Retail Price
The Regular Retail Price (“RRP”) is the standard price that Guitar Excellence CC & GE Online (Pty) Ltd charges for the product. The RRP is determined by considering the suppliers’ price, market conditions, and the prices being offered by other local retailers as well as currency fluctuations.
Please note that RRPs can change over the course of several seasons, months, weeks and days over which the product may be sold. The RRPs applicable at the time the product is introduced may differ from the RRP at the time of your purchase.
The Discount Price
When Guitar Excellence CC & GE Online (Pty) Ltd is having a sale or is running a discounted promotion on specific products on the site – the discount price is shown on the product’s product page, as well as the Regular Retail Price (“RRP”). The discount price will be shown in red and the RRP will be shown alongside it – but will be crossed out.
When a discount price is shown on the product page, the discount price is the price you will pay when you add the product to your cart at the discounted price, and conclude the sale at the discounted price i.e. the purchase price.
Pricing Accuracy
Every reasonable effort will be made to ensure that the RRP and, if applicable, the Discount Price of all products on Guitar Excellence CC & GE Online (Pty) Ltd are correct at the time of your purchase. If, however, the product is offered at an erroneous price, Guitar Excellence CC & GE Online (Pty) Ltd will not be obliged to supply the said product at the incorrect price.

Delivery Fees
For orders of R500.00 or more, in Johannesburg, Cape Town & Pretoria within South Africa, Guitar Excellence CC & GE Online (Pty) Ltd delivers door-to-door free of charge.
For orders under R500.00 in Johannesburg, Cape Town & Pretoria within South Africa, Guitar Excellence CC & GE Online (Pty) Ltd charges a fee to be confirmed at check-out to deliver door-to-door with your teacher at your next scheduled weekly lesson dependent on stock availability and may take up to 21 working days.
Making a Payment
Guitar Excellence CC & GE Online (Pty) Ltd only accepts payments made by Visa and MasterCards, as well as chipped debit cards that have been activated for online purchases only. When you place an order, the transaction details are presented to the bank and payment gateway for authorisation of the payment amount.
If authorisation is not obtained, the order is cancelled. If authorisation is obtained, payment is usually immediate. You guarantee that you are fully authorized to use the credit card for payment of your order and that there are sufficient funds in this credit card account to cover the costs of any transactions you complete with Guitar Excellence CC & GE Online (Pty) Ltd at www.guitarexcellence.co.za
Guitar Excellence CC & GE Online (Pty) Ltd delivers and collects your orders directly to and from your residential address where your weekly home lessons are confirmed with Guitar Excellence CC & GE Online (Pty) Ltd. Upon submitting your address during checkout the only acceptable delivery address is your registered home address where your home lessons subscription takes place every week with your teacher.
Guitar Excellence CC & GE Online (Pty) Ltd accepts no responsibility of the handing over of guitars and amps to your teacher for repairs and maintenance services purchased with Guitar Excellence CC & GE Online (Pty) Ltd. It is up to the buyer or pupil to ensure that all goods handed over to your teacher are insured in the case of loss, theft or any other cause whatsoever.
Defective Items, Returns and Reimbursement
Guitar Excellence CC & GE Online (Pty) Ltd does not hold stock of any goods as seen on the website therefore, cannot accept returns for incorrect orders placed and cannot issue refunds under these circumstances unless goods are faulty, damaged or broken. The warranty will be fulfilled by our suppliers.
If your parcel is lost due to theft, loss, act of God or any other cause whatsoever your teacher assigned to you is solely responsible for the replacement of your order. Guitar Excellence CC & GE Online (Pty) Ltd is not responsible for goods handed over to your teacher for our repair services or for goods lost, damaged in transit from your teacher. Your teacher is solely responsible for the replacement of your order regarding all orders placed with Guitar Excellence CC & GE Online (Pty) Ltd as well.
Warranty
If a product is bought within the stipulated time frame of 14 days, it may qualify to be covered under supplier’s warranty.
The Consumer Protection Act now reinforces in South Africa what has been stipulated in warranty documents included with products stating:
1. Warranty, often mistakenly called a guarantee, is a legally binding assurance that the product has certain properties.
2. If a product becomes defective within a specified period of time, it may either be replaced or repaired within the warranty terms.
3. Warranty states that the goods have no hidden defects or defects that originate at the point of production that will make them unfit for the purpose for which they were bought.
4. If there is a hidden defect or the defect originates as a result of a defect created at the production point, the warranty within the specified time is applicable.
5. The CPA also states that there is an implied term that the goods are reasonably suitable for the purposes for which they are intended.
6. Any form of warranty lapses should the goods have been tampered with or opened at any place other than the distributor designated by the brand’s workshop or a workshop appointed by the distributor.
In order for a product to be covered under warranty the following factors need to be applicable:
1. It must have been purchased by the end-user within the applicable warranty time frame specified by the manufacturer.
2. The defect must be as a result of a latent defect that originated at the point of production that makes the item unfit for the use it was intended.
3. No person other than a repair person appointed by the distributor has opened the item.
What deems an item not to be covered under warranty:
1. Defects or technical issues that fall outside of the manufacturer’s control.
2. When products work’s as they are intended to work, but due to external factors that the supplier or manufacturer has no control of, these products fall outside of warranty.
3. When it is deemed that the external factors of usage, wear and tear created the fault and the fault did not originate as a result of an internal production defect.
Security
Anyone trying to download malware or damaging coding on guitarexcellence.co.za, or who tries to gain unauthorized access to any page on this site, will be prosecuted.
Guitar Excellence CC & GE Online (Pty) Ltd will claim civil damages from such person if Guitar Excellence CC & GE Online (Pty) Ltd suffers any damage or loss.
You agree and guarantee that the username and password you use to log in is for your personal use only, and will not be passed on to any third party.
You allow Guitar Excellence CC & GE Online (Pty) Ltd to take all steps reasonably possible to ensure the integrity and security of the site and in the administrative office.
All credit card transactions on the site are protected by SSL (Secure Socket Layer) encryption and reinforced by various encryption processes with the aim of offering the most effective possible protection of any sensitive information. Guitar Excellence CC & GE Online (Pty) Ltd has no access to any confidential information regarding your payment method.

Indemnity
