Access to and use of the Site and all associated services—including online guitar lessons, courses, learning resources, subscriber forums, and other related features (collectively, the “Services”)—are governed by the following Terms and Conditions (“T&Cs”).

By accessing or using the Site or Services, you (“the User” or “Subscriber”) agree to be bound by these T&Cs, which form a binding legal agreement between you and Guitar Excellence.

The most recent version will be published on our official websites. It is your responsibility to review the current T&Cs periodically. Continued use of the Site or Services following any changes will constitute your acceptance of the updated T&Cs.

Nothing in these T&Cs will be interpreted so as to exclude or limit your rights under the Consumer Protection Act, 2008 (CPA), where applicable.

Guitar Excellence & GE Online Services

Video Lesson Subscription

Guitar Excellence CC and GE Online (Pty) Ltd (“Guitar Excellence”, “GE Online”, “we”, “our”) provide access to guitar-related educational content and services (“Services”) via this website (“Site”). While general information may be accessed freely by visitors, full use of the Services requires user registration and an active, paid subscription.

Subscription Terms

Subscriptions are billed on a recurring basis (monthly or quarterly), and payment is required in advance to maintain access to the Services. All subscription plans are subject to automatic renewal, and no automated reminders will be issued prior to billing. By subscribing, you agree to be automatically charged at the start of each new billing cycle unless and until the subscription is cancelled via PayFast, PayPal, or through your account settings.

You will receive a confirmation email upon subscription activation. It is your responsibility to review and verify the accuracy of this information. Additional service or transaction fees may be charged by your chosen payment gateway.

Subscriptions may only be purchased by individuals aged 13 years or older. If the account is created for or used by a minor under 18, a parent or legal guardian must supervise all use and be the legal account holder.

7-Day Trial Guarantee

If you are not satisfied, you may request a refund within 7 (seven) calendar days of your initial subscription, provided:

  • You have not attended or scheduled any live lesson, and

  • Your total login time to the Site does not exceed 60 minutes within the trial period.

This guarantee is strictly limited to first-time subscribers and cannot be claimed more than once per user.

No Refund Policy Beyond Trial

Except as explicitly stated under the 7-Day Trial Guarantee, all subscriptions are non-refundable, including but not limited to cases where lesson time has been reserved or missed, as lesson slots are allocated exclusively and prevent bookings by other users. This model constitutes a made-to-order” service under the Consumer Protection Act, Section 17(3), which limits cancellation rights once a service has been committed to a specific date or time at the customer’s request.

Online Lesson Subscription

Guitar Excellence CC and GE Online PTY (Ltd) provide four (4) scheduled online guitar lessons per month under a monthly automated subscription. Some months may include five (5) lessons or fewer where South African public holidays apply. An annual break occurs in December for 3–4 weeks, accounted for by months with five (5) lessons during the year.

Booking, Attendance & Cancellations

Each lesson is reserved in advance and cannot be resold, forming part of a time-slot-based model. Missed lessons are non-refundable. This model is protected under Section 17(4)(b) of the Consumer Protection Act (CPA) as it involves services booked for a specific time.

  • Cancellations with at least 7 days’ notice may be rescheduled, subject to instructor availability and at their discretion.
  • No-shows or cancellations with less than 7 days’ notice will be forfeited, with no credit or refund.

If the lesson is interrupted by external issues (e.g., load shedding, bad weather, connectivity issues), it will be rescheduled. No refunds or credits will be issued for these cases.

First-time subscribers may cancel within 7 days if no lesson has been booked or attended, and login time is under 60 minutes.

Technology & Readiness

A minimum 10Mbps connection, computer, webcam, and video conferencing app (Zoom/Skype) are required. Guitar Excellence is not responsible for pupil progress, motivation, or results, but commits to providing quality instruction and materials.

Subscription Timing & Renewals

  • Subscriptions renew automatically each month unless cancelled in your payment platform.
  • November may not be used as a cancellation month for subscribers beyond 3 months; December will serve as the termination period.
  • South African public holidays and the December break are observed; affected lessons are built into the annual calendar.

Liability & Force Majeure

Instructors are independent contractors vetted and supported by Guitar Excellence. While quality is monitored, we are not liable for contractor behaviour and any claims arising from it. Pupils agree to raise concerns directly with Guitar Excellence immediately.

In the event of force majeure (acts beyond our control including acts of God or government), Guitar Excellence and its instructors are released from liability for any failure to perform under the contract.

Reservation of Rights and Termination

Guitar Excellence and GE Online reserve the right to suspend or terminate a pupil or subscriber’s access to the site or subscription services in cases of:

  • Breach of terms and conditions, including abuse, fraud, or failure to pay;

  • Misuse of the platform, including disruptive or offensive behavior toward instructors;

  • Violation of reasonable conduct expected during lessons.

Where appropriate, reasonable notice and an opportunity to remedy the breach will be provided before termination. In cases of serious or repeated breach, termination may be immediate. Refunds in these cases will be at the sole discretion of Guitar Excellence and GE Online, in line with the Consumer Protection Act.

Username/Password Protection

Upon subscribing for video lessons, users will be required to create an account with a secure username and password. These login credentials grant access to the appropriate level of services based on the user’s subscription tier.

By registering, you agree to:

  • Maintain the confidentiality and security of your login details.

  • Take all reasonable steps to prevent unauthorised access or use of your account.

  • Ensure that all personal and payment information linked to your account remains accurate and up to date.

Guitar Excellence CC and GE Online (Pty) Ltd reserve the right to:

  • Monitor access and usage for account integrity and misuse.

  • Restrict or terminate a user’s access to the Services at any time, at our sole discretion, for violations of these terms or where continued access is deemed to pose a risk to the integrity or operation of the platform.

  • Suspend or delete user accounts without prior notice in cases of abuse, unauthorised access, or breach of these Terms.

Nothing in this clause limits your statutory rights under the Consumer Protection Act, 2008, but we reserve the right to enforce access limitations to protect our services, instructors, and subscriber community.

Lesson Cancellations, Subscription Termination & Force Majeure

Lesson Cancellation:

  • If a scheduled lesson is cancelled by the instructor and cannot be rescheduled within a reasonable timeframe, a credit will be processed to your payment method (PayPal/PayFast).

  • If a subscriber or pupil cancels or fails to attend a scheduled lesson for any reason, that lesson is forfeited and will not be rescheduled, credited, or refunded.

  • Lessons falling on South African public holidays will not take place. Where applicable, such lessons may be rescheduled at the instructor’s discretion.

  • Acknowledgment of Notice: Guitar Excellence CC and GE Online PTY (Ltd) will acknowledge receipt of your written cancellation notice within two (2) business days. The cancellation will only be considered valid upon written acknowledgment from Guitar Excellence, and the cancellation will take effect at the end of the next full billing cycle following the notice period.

  • Termination in November: For subscribers who have received lessons for three (3) consecutive months or more in a fiscal year, November cannot be used as the cancellation month. In such cases, December will serve as the designated termination month.

  • Responsibility for Payment Management: Guitar Excellence CC and GE Online PTY (Ltd) cannot cancel subscriptions on your behalf via PayPal, PayFast, or any other third-party payment provider. Subscribers are responsible for managing and cancelling any recurring payments directly through their payment provider’s platform.

  • Effect of Cancellation: Upon valid cancellation notice, the subscription will be deactivated within two (2) business days following the expiration of the current billing cycle. If the cancellation is made in the final month of the subscription, the service will continue until the end of that billing period.

Subscription Duration:

  • Subscriptions are valid for a 30-day billing period, during which subscribers will receive a minimum of four (4) lessons, and occasionally five (5), depending on the calendar month.

  • Non-attendance of scheduled lessons by the subscriber or pupil for any reason will not entitle the subscriber to a refund, credit, or rescheduling.

Warranty

If a product is bought within the stipulated time frame of 14 days, it may qualify to be covered under supplier’s warranty.

The Consumer Protection Act now reinforces in South Africa what has been stipulated in warranty documents included with products stating:

1. Warranty, often mistakenly called a guarantee, is a legally binding assurance that the product has certain properties.
2. If a product becomes defective within a specified period of time, it may either be replaced or repaired within the warranty terms.
3. Warranty states that the goods have no hidden defects or defects that originate at the point of production that will make them unfit for the purpose for which they were bought.
4. If there is a hidden defect or the defect originates as a result of a defect created at the production point, the warranty within the specified time is applicable.
5. The CPA also states that there is an implied term that the goods are reasonably suitable for the purposes for which they are intended.
6. Any form of warranty lapses should the goods have been tampered with or opened at any place other than the distributor designated by the brand’s workshop or a workshop appointed by the distributor.

In order for a product to be covered under warranty the following factors need to be applicable:

1. It must have been purchased by the end-user within the applicable warranty time frame specified by the manufacturer.
