Home-Based Lesson Subscription Service

Guitar Excellence CC and GE Online PTY (Ltd) provide in-home guitar instruction on a subscription basis, comprising four (4) scheduled lessons per calendar month. Lessons are conducted at the subscriber’s home at a fixed day and time each week by an instructor appointed by Guitar Excellence CC and GE Online PTY (Ltd). Instructor assignments may be modified at the discretion of the company without prior notice, and such changes shall not constitute grounds for cancellation, refund, or claim.

Due to variable traffic conditions and weather-related delays beyond the reasonable control of the instructor, a grace period of fifteen (15) minutes before or after the scheduled lesson time is permitted. This allowance ensures reasonable arrival flexibility and shall not affect the duration or quality of the lesson.

The monthly subscription fee remains constant throughout the year, regardless of the number of lessons falling in a specific month. This fixed rate accommodates fluctuations, including months with five (5) scheduled weeks or fewer lessons due to public holidays. Guitar lessons are not provided on officially recognised South African public holidays. Should an instructor be unavailable for any reason, affected lessons will either be rescheduled or a credit will be applied to the subscriber’s account at the sole discretion of Guitar Excellence CC and GE Online PTY (Ltd).

An annual break is observed from approximately the second week of December to the first or second week of January, during which no lessons will take place. This break, typically lasting three (3) to four (4) weeks, is accounted for over the subscription year by including additional lessons during months that contain five (5) weeks.

Subscribers who enrol before 1 August of any given year will be billed in arrears for lessons delivered during December. Subscribers who join on or after 1 August will be invoiced in advance for December to align with the annual subscription cycle.

Subscribers may request a migration to an alternative service tier or lesson format. Such changes require at least one (1) full calendar month’s written notice and will be subject to a downgrade or administration fee where applicable.

All active subscribers receive exclusive access to Guitar Excellence CC and GE Online PTY (Ltd)’s online store and high-definition on-demand lesson library for the duration of their valid subscription.

Missed or Cancelled Lessons At Home

All home-based guitar lesson subscriptions are structured around reserved weekly time slots. By subscribing to this service, you are securing a specific appointment with an instructor on a recurring basis, and fees are charged for the booked time regardless of attendance. Accordingly, any lesson missed, skipped, or cancelled by the pupil for any reason whatsoever—including but not limited to illness, personal commitments, holidays, exams, or travel—will be charged in full.

Subscribers are requested to inform their assigned teacher of any planned absences at least one (1) calendar month in advance wherever reasonably possible. Where sufficient notice is provided, Guitar Excellence CC and GE Online PTY (Ltd) will make every reasonable effort to reschedule the lesson within the same billing cycle, subject to the availability of the teacher and pupil. However, rescheduling is not guaranteed, and if a makeup lesson cannot be accommodated, the originally scheduled lesson will still be billed.

For unplanned absences, a minimum of 24 hours’ notice is required. Notification within this period does not guarantee a makeup lesson but may assist in attempting to reschedule. Failure to provide the required notice or repeated cancellations may affect eligibility for rescheduling and may result in continued billing for reserved time.

In the event that your teacher is unable to attend a scheduled lesson, Guitar Excellence CC and GE Online PTY (Ltd) will arrange a suitable makeup lesson, subject to the pupil’s availability, or issue a credit note to your account for the missed session.

This policy ensures fairness and sustainability in service delivery, acknowledges the time reserved by instructors, and supports effective scheduling for all clients.

Payment Terms

Guitar Excellence CC and GE Online PTY (Ltd) accepts payment for home-based subscription services strictly via Electronic Funds Transfer (EFT), direct bank deposit, or debit order. By subscribing to our services, the payer agrees to adhere to the payment method selected and to ensure timely settlement of all amounts due.

Guitar Excellence CC and GE Online PTY (Ltd) reserves the right to suspend or permanently terminate services in the event of any non-payment or overdue amounts, without prior notice. Persistent or unresolved non-payment may result in the account being handed over to collections and/or reported to a registered credit bureau (including ITC), and legal recovery action may be initiated. The payer agrees to be liable for all legal, administrative, and collection costs incurred by Guitar Excellence CC and GE Online PTY (Ltd) in the recovery of outstanding debt, including attorney and client costs, and tracing fees where applicable.

EFT or Direct Deposit

Clients who choose to pay via EFT or direct deposit are required, upon initiation of service, to make an upfront payment equivalent to two (2) months’ subscription fees. One month will be applied to the current billing cycle, and the second will serve as a notice deposit, which may be applied against the final month of tuition following a valid termination of subscription, subject to the required notice period being honoured.

Should the payer elect not to use the deposit for final tuition, the deposit may alternatively be converted into a 12-month on-demand video access subscription upon termination of in-person lessons. This alternative must be exercised within 30 days of the lesson service ending.

All EFT or direct deposit payments must include the invoice reference or purchase order number provided, to ensure proper allocation. Failure to include a reference may result in delays in account reconciliation or suspension of service.

Debit Order

Debit orders are processed in advance on the 30th of each month. No deposit is required for customers on a valid debit order arrangement. The payer authorises Guitar Excellence CC and GE Online PTY (Ltd) to collect the agreed subscription fee monthly via debit order from the nominated bank account, and to continue doing so until valid written cancellation has been received and acknowledged in accordance with our notice and cancellation policy.

Gift Vouchers

Gift vouchers issued by Guitar Excellence CC and GE Online PTY (Ltd) are valid strictly for the period stated on the voucher or related product description at the time of purchase. All vouchers carry a clearly defined expiry date and are not open-ended. Failure to redeem the gift voucher within the specified validity period will result in automatic forfeiture of the associated lessons and/or access, with no entitlement to extension, credit, or refund.

Gift vouchers are non-refundable and may not be exchanged for cash, credited to an account, or resold. All sales of gift vouchers are final.

It is the sole responsibility of the recipient to redeem the voucher and to meet the minimum subscription or scheduling requirements for lessons to be initiated. Guitar Excellence CC and GE Online PTY (Ltd) bears no responsibility for the recipient’s failure to initiate or complete the lesson process within the allocated timeframe.

By purchasing or redeeming a gift voucher, the purchaser and recipient accept these terms in full.

Refund Policy

All subscriptions to Guitar Excellence CC and GE Online PTY (Ltd) services are strictly non-refundable. By subscribing, you acknowledge and agree that your payment secures a reserved instructional time-slot with a designated instructor, as well as access to value-added services including but not limited to our exclusive online platform and lesson resources.

Guitar Excellence CC and GE Online PTY (Ltd) may, in its sole and absolute discretion, consider refund requests in exceptional circumstances. Exceptional circumstances may include, but are not limited to, cases where services were not rendered as agreed due to reasons directly attributable to the company, and where no reasonable alternative (such as a substitute lesson, credit note, or online alternative) could be offered.

Where a refund is approved, it will be processed only once per billing cycle and may take up to thirty (30) days to reflect, depending on banking and administrative processes. No refund requests will be considered after the expiry of thirty (30) calendar days from the date of the original transaction.

Refunds will not be granted for missed or unattended lessons, scheduling conflicts, non-use of access to online content, or general dissatisfaction with progress, results, or instructor compatibility. Clients are encouraged to raise concerns with management promptly to allow for resolution without disruption to scheduled instruction.

Intellectual Property and Media Usage

All learning materials, including but not limited to notes, tutorials, images, videos, sound recordings, and examination resources, whether physical or digital, remain the exclusive intellectual property of Guitar Excellence CC and GE Online PTY (Ltd), unless explicitly stated otherwise in writing. These materials are licensed for personal, non-commercial use by the individual learner to whom they are issued and may not be shared, copied, duplicated, scanned, distributed, republished, or adapted in any form whatsoever without the prior written consent of Guitar Excellence CC and GE Online PTY (Ltd).

All music content, including transcriptions, notes, and instructional interpretations shared during lessons, constitutes an original educational adaptation and is protected by copyright. These materials are provided solely for the educational use of the pupil and may not be exploited or disseminated outside the scope of lessons without explicit permission.

In addition, all photographs, video recordings, testimonials, and other media captured during or in relation to lessons may be used by Guitar Excellence CC and GE Online PTY (Ltd) for promotional, educational, or marketing purposes across its digital platforms, including websites and social media. The company undertakes not to disclose any personal or sensitive information about minors or learners, apart from their first name, in any public media.

By enrolling in our services, the client consents to the use of such media, unless written notice of objection is submitted to the company in advance. Consent for minors must be provided or withdrawn by the legal guardian.

Guitar Excellence CC and GE Online PTY (Ltd) reserves all legal rights to enforce this clause in the event of any infringement or unauthorised use.

Progress, Motivation and Learning Outcomes

Guitar Excellence CC and GE Online PTY (Ltd) and its instructors commit to delivering structured, professional, and high-quality tuition designed to support the musical development of each pupil. However, the company makes no guarantees, express or implied, regarding the learner’s progress, motivation, skill acquisition, or overall success. Musical advancement is inherently dependent on a range of personal factors, including the pupil’s commitment, consistent attendance, aptitude, and practice habits outside of lesson time.

While reasonable efforts will be made to encourage and facilitate steady improvement, Guitar Excellence CC and GE Online PTY (Ltd) cannot be held liable for lack of progress or achievement of specific results, goals, or milestones. Instruction is delivered as a support structure and not as a substitute for personal discipline or sustained individual effort.

By enrolling in our services, the client and pupil acknowledge that learning outcomes may vary and accept that results cannot be guaranteed.

Termination and Notice Period

One (1) full calendar month’s written notice is required to terminate any subscription agreement with Guitar Excellence CC and GE Online PTY (Ltd). Notice must be submitted in writing using the official termination form provided by the company and sent to [email protected]. Termination will only be effective once Guitar Excellence CC and GE Online PTY (Ltd) has acknowledged receipt of the termination notice via email. This acknowledgment will confirm the termination date, which will be the first (1st) day of the following month after receipt of the notice.

In the event that the customer submits a termination notice after the first (1st) day of any calendar month, the termination period will begin on the first (1st) day of the subsequent month, and services will continue and be billed accordingly until the end of that month.

Please note that no cancellations will be accepted during the month of November due to the billing structure that accounts for non-teaching periods such as public holidays and the December break. Customers who wish to cancel during November must understand that their subscription will terminate on 31 December, and full payment for December will be due.

For customers who have subscribed for less than thirteen (13) consecutive months, their final month will consist of four (4) lessons, as the full month’s lesson schedule is not available.

It is the responsibility of the client to ensure the termination letter is completed, submitted, and acknowledged by Guitar Excellence CC and GE Online PTY (Ltd) in writing via email. Until the official acknowledgment is received, the subscription remains active, and lessons will continue as scheduled.

Instructor Conduct and Liability Indemnity

Guitar Excellence CC and GE Online PTY (Ltd) is dedicated to maintaining high standards by thoroughly screening all instructors to ensure that only qualified, professional, and competent guitar instructors are selected to teach its clients. However, Guitar Excellence CC and GE Online PTY (Ltd) cannot be held liable for any actions or conduct of its instructors, as each instructor operates as an independent contractor under a separate agreement with Guitar Excellence CC and GE Online PTY (Ltd).

As such, Guitar Excellence CC and GE Online PTY (Ltd) provides no warranty, guarantee, or assurance regarding the individual actions, behavior, or performance of any instructor. The client agrees to indemnify and hold Guitar Excellence CC and GE Online PTY (Ltd) harmless from any and all claims, liabilities, damages, losses, or expenses arising from any act or omission by an instructor while providing lessons under the auspices of Guitar Excellence CC and GE Online PTY (Ltd).

In the event that an instructor is unable to fulfill their obligations under the contract due to circumstances beyond Guitar Excellence CC and GE Online PTY (Ltd)’s control (including but not limited to acts of God, government intervention, natural disasters, or other force majeure events), Guitar Excellence CC and GE Online PTY (Ltd) and its contractors will be discharged from any liability. This includes but is not limited to disruptions caused by external factors that affect the ability to deliver the scheduled lessons.

Should the client become aware of any concerns regarding the conduct, behavior, or quality of instruction provided by an instructor, the client agrees to immediately notify Guitar Excellence CC and GE Online PTY (Ltd) so that the matter can be investigated and resolved as efficiently as possible.

Non-Solicitation of Instructors

All lessons with Guitar Excellence CC and GE Online PTY (Ltd) are scheduled and confirmed directly between the client and the assigned instructor. The client acknowledges and agrees that Guitar Excellence CC and GE Online PTY (Ltd) has invested significant resources in identifying, recruiting, and contracting instructors for the provision of guitar lessons. Accordingly, the client agrees not to, directly or indirectly, solicit, hire, or engage the services of any instructor introduced to them by Guitar Excellence CC and GE Online PTY (Ltd) for private tuition or any other form of instructional services related to guitar playing, either during the term of the client’s contract with Guitar Excellence CC and GE Online PTY (Ltd) or for a period of 12 months after the termination of the instructor’s contract with Guitar Excellence CC and GE Online PTY (Ltd).

Furthermore, the client agrees not to request, accept, or receive guitar tuition from any instructor who has ceased to be contracted with Guitar Excellence CC and GE Online PTY (Ltd) for a period of 12 months following the termination of that instructor’s engagement with Guitar Excellence CC and GE Online PTY (Ltd). This restriction applies regardless of whether the instructor approaches the client or the client approaches the instructor.

The client acknowledges that any breach of this clause may result in legal action and/or termination of their subscription with Guitar Excellence CC and GE Online PTY (Ltd) in accordance with the applicable terms and conditions.
